How much does a OUI cost in Massachusetts?

A first OUI in Massachusetts carries a statutory fine of $500–$5,000. This guide stacks every cost layer an official Massachusetts source prices — the fine, court costs, the license reinstatement fee, the OUI program, ignition interlock, and the SR-22 insurance filing — and says plainly which layers no official source prices at all.

Massachusetts OUI costs at a glanceFigure
Statutory fine — first OUIA first OUI offense carries a fine of $500 to $5,000 (or up to two and a half years in jail, or both). The statute also adds two mandatory assessments that cannot be waived: $250 for the Head Injury Treatment Services Trust Fund and $50 for the Victims of Drunk Driving Trust Fund.
Statutory fine — second OUIThe statute separates a second offense: $600–$10,000. Second offenses also carry longer suspensions and program requirements — see the sections below.
Court costs & feesNo single statewide court-cost figure is published in the official Massachusetts sources reviewed, so court costs are additional and are set in the individual case.
License suspension — first offenseOn conviction, the RMV revokes the license for one year for a first offense. A first offender who is instead assigned to the alcohol education program under Chapter 90, Section 24D has the license suspended for 45 to 90 days, and a limited hardship license may be available partway through a revocation for work or education.
License reinstatement feeMass.gov states that reinstatement fees are set by Chapter 90, Section 33 and range from $100 to $1,200 depending on the violation, and it does not publish a single first-offense OUI amount, so no single figure is recorded. A hearings officer must authorize reinstatement.
Ignition interlockConditional — restricted license / court order — An ignition interlock device is not required for a standard first offense; the RMV requires one for drivers with two or more OUI convictions or program assignments, and the Registrar may require one on a hardship license, including where the blood alcohol level was 0.15 or higher. No official device price is published.
OUI education / treatment programFirst offenders are typically assigned to the state alcohol education program under Section 24D, now called the Massachusetts Impaired Driving Program (formerly the Driver Alcohol Education Program). No official program fee was published on the official pages reviewed.
SR-22 insurance filingWhether Massachusetts requires an SR-22-type filing after an OUI could not be verified from an official page opened in this research, so it is recorded as unverified. A conviction generally leads insurers to treat a driver as higher risk, which can raise premiums; no official source states a dollar figure.

The fine

A first OUI offense carries a fine of $500 to $5,000 (or up to two and a half years in jail, or both). The statute also adds two mandatory assessments that cannot be waived: $250 for the Head Injury Treatment Services Trust Fund and $50 for the Victims of Drunk Driving Trust Fund.

Court costs & fees

No single statewide court-cost figure is published in the official Massachusetts sources reviewed, so court costs are additional and are set in the individual case.

License suspension & reinstatement

On conviction, the RMV revokes the license for one year for a first offense. A first offender who is instead assigned to the alcohol education program under Chapter 90, Section 24D has the license suspended for 45 to 90 days, and a limited hardship license may be available partway through a revocation for work or education.

Mass.gov states that reinstatement fees are set by Chapter 90, Section 33 and range from $100 to $1,200 depending on the violation, and it does not publish a single first-offense OUI amount, so no single figure is recorded. A hearings officer must authorize reinstatement.

The national picture — which states charge the most to reinstate — is in our license reinstatement guide.

Ignition interlock

An ignition interlock device is not required for a standard first offense; the RMV requires one for drivers with two or more OUI convictions or program assignments, and the Registrar may require one on a hardship license, including where the blood alcohol level was 0.15 or higher. No official device price is published.

How interlock pricing works (installation, monthly lease, calibration, removal) is in our ignition interlock cost guide.

OUI education & treatment program

First offenders are typically assigned to the state alcohol education program under Section 24D, now called the Massachusetts Impaired Driving Program (formerly the Driver Alcohol Education Program). No official program fee was published on the official pages reviewed.

SR-22 & insurance

Whether Massachusetts requires an SR-22-type filing after an OUI could not be verified from an official page opened in this research, so it is recorded as unverified. A conviction generally leads insurers to treat a driver as higher risk, which can raise premiums; no official source states a dollar figure.

Towing, impound & other charges

Refusing a chemical test carries its own administrative suspension of 180 days for a first refusal, and the vehicle is impounded for 12 hours at the time of refusal. Separate suspensions arising from the same incident are served consecutively.

Worked total: the verified charges stacked

ItemCost
Statutory fine$500–$5,000
Total of the verified state-set charges above$500–$5,000

That total is deliberately incomplete: it leaves out everything no official Massachusetts source prices statewide — court costs where they are set county by county, interlock lease payments to a private vendor, towing and storage, and the insurance increase that follows an SR-22. Add your own figures for those in the cost calculator.
